Open Notes (Cures Act), the “Preventing Harm Exception” to Information Blocking and a “Duty to Warn” Update: Ethics and Legalities
As of April 5, 2021, the 21st Century Cures Act requires that patients be provided access to their electronic health information (EHI) and that access to such information not be blocked. Eight exceptions to information blocking have been established. The “preventing harm exception” allows the practitioner to engage in practices that are reasonable and necessary to prevent harm to a patient or another person. We will look at the Information Blocking rule and its exceptions, focusing on the preventing harm rule. Additionally, we will discuss updates to the “duty to warn.”
