Implications of Proposed Changes to Lawyers’ Client Due Diligence Obligations

The Rules of Professional Conduct attempt to balance lawyers’ ethical responsibilities to their clients, including robust protections for confidential information, with the need to respond to crimes such as money laundering, terrorism financing, forced labor, and trafficking in persons. These crimes can all involve the services of lawyers. The American Bar Association has proposed amending the Model Rules of Professional Conduct to require lawyers to make a reasonable inquiry of a client when there are risk factors for terrorism financing, money laundering, or similar activities. If these proposed rules become mandatory in state codes of professional conduct, the implications could be significant for lawyers and clients. This CLE will cover lawyers’ current obligations, the proposed changes, and the implications of those proposals.

Professor Patrick Keenan is Professor of Law and Hurd Faculty Scholar at the University of Illinois College of Law. He researches and teaches about professional responsibility and ethics, human rights, counterterrorism law, and international law. He has published articles on the U.S. drone program, international criminal law and conflict minerals, human trafficking and tourism, China’s role in Africa, the human rights potential of sovereign wealth funds, the International Finance Corporation’s investments in Africa and the Caribbean, and many other issues. Professor Keenan has taught courses on counterterrorism law, international criminal law, public international law, human rights, and the ethical responsibilities of lawyers. He also created, and for 10 years directed, the Human Rights Law Clinic, in which students worked directly with lawyers and advocates in Africa and the Caribbean on human rights issues. Professor Keenan graduated from Yale Law School and Tufts University.

This course is approved for 1.00 Illinois MCLE general credit hours, PR/Ethics credit is pending approval.
