The Supreme Court is likely to decide two big questions arising out of the attack on the Capitol on January 6, 2021 that will impact Donald Trump’s candidacy for president in the 2024 election.  

First, does section 3 of the Fourteenth Amendment, which bars from future office persons who took an oath to uphold the Constitution but “engaged in insurrection,” preclude Trump’s candidacy (and may states so determine and remove Trump from the ballot)? Second, is Trump correct that former presidents have absolute immunity from criminal prosecution for conduct they engaged in while in office so that the pending criminal cases against him must all be dismissed?
